Dooney Loyalists Reward Program Terms And Conditions

EFFECTIVE February 20, 2020

1. OVERVIEW

Please read the full Terms and Conditions ("Terms") below carefully. By becoming a Member of the Dooney Loyalists Reward Program (the "Program"), you agree to these Terms as well as all terms applicable to having a Dooney & Bourke account (“Account”). If you do not agree, do not join. Joining requires creating (or having) an Account in the Dooney & Bourke Mobile App ("App") or at either www.dooney.com or www.ilovedooney.com (the “Websites”). Accounts are free.

Subject to these Terms, Members can earn points (“Points”) on the amounts they spend on qualifying purchases via the App, via either of the Websites, and in Dooney & Bourke stores. Additional earning opportunities also may be offered from time to time. Points may be redeemed for reward value toward future purchases only online at the Websites.

The Program is valid only in the U.S. Void where prohibited or restricted. Dooney & Bourke reserves the right to modify or terminate the Program at any time, including changing or terminating the number and type of benefits offered to Members in its sole discretion at any time.

2. MEMBERSHIP

a. Eligibility. You must be age 18 years or older and a resident of the 50 United States or D.C. to become a Member. Dooney & Bourke employees are not eligible. Membership is limited to individuals only, and is limited to one Account per individual. Accounts are personal and cannot be sold, transferred or assigned to, or shared with friends, family or others. The Program is void where prohibited by law, and is subject to change as may be necessary to comply with such laws or regulations.

b. Becoming a Member. To become a Member, you first must create (or have) an Account in the App or at either of the Websites. All terms applicable to having an Account also apply.

c. Account Responsibility. Dooney & Bourke is not responsible for the use of Accounts or redemption of a Member's points. It is the Member's responsibility to manage unauthorized use or redemption of Points by family or friends or other individuals who might have access to the Member's Account. In the event a Member's Account is stolen and the Account is used, or any Points are redeemed, the Member must inform Dooney & Bourke and the Account will go under investigation to determine what remedy, if any, may be available. Members are responsible to keep their contact and other information current and accurate. Dooney & Bourke is not responsible for communications failures or other problems caused by out-of-date or inaccurate information furnished by a Member.

d. Communication Options & Preferences. Members may be asked from time to time to submit information about themselves to enable Dooney & Bourke to provide more personalized offers and experience. All information submitted is subject to the Dooney & Bourke’s Privacy Policy. Program-related communications to Members may include email, push notifications, in-App messaging, and SMS text messaging.

e. Additional Benefits. Additional Member benefits, such as special promotions, offers or events, may be available from time to time. These benefits will be subject to the terms and conditions of each respective promotional offer, including, without limitation, minimum qualifying purchase requirements and applicable expiration dates.

f. Cancellation

  1. By Member: You may cancel your Program membership at any time by contacting our customer service team. Upon cancellation, any unused Points accrued in your Account will be forfeited and cannot be redeemed.
  2. By Dooney & Bourke: Dooney & Bourke reserves the right to cancel any Member's account at any time if such Member violates these Terms, engages in fraudulent conduct, or otherwise abuses the Program as determined in Dooney & Bourke’s sole discretion.
  3. Effect of Termination: If an Account becomes terminated by either Dooney & Bourke or the Member, all previously earned Points and any benefits automatically terminate and become null and void. Subsequent re-enrollment by the same Member will be at a zero-point balance. Dooney & Bourke reserves the right to refuse re-enrollment to any terminated Member based on previous fraudulent, abusive, or otherwise inappropriate behavior as determined by Dooney & Bourke in its discretion.

3. EARNING POINTS

a. General. Points may only be earned on eligible purchases made via the App, on either of the Websites, or in Dooney & Bourke stores. Members must be logged into their Account at the time of purchase to earn Points on eligible purchases made in the App or on either of the Websites. To earn Points on eligible purchases made in-store, a Member must supply the email address that correlates to his/her Account at the time of purchase. Points for any qualifying purchase can only be credited to one Account. No splitting of purchases or Points.

b. Earning Points for Purchases. Members earn Points for each dollar spent on the purchase of qualifying products in qualifying transactions. The number of Points a Member earns depends on Tier level, per Section 5 below. Purchase amounts are rounded up to the next dollar increment.

c. Exclusions. Calculation of Points is based solely on the purchase price actually paid for items, minus all discounts, and excluding amounts paid for taxes, shipping, or gift cards. Dooney & Bourke may exclude certain products from counting as qualifying purchases by disclosing at the point of purchase that such items are excluded. Purchases made by a Member prior to joining the Program are not eligible for Points.

d. Timing of Addition of Points to Accounts. Generally, Points are automatically added to a Member's Account within 72 hours after completion of the qualifying purchase in-store or within 72 hours after a qualifying purchase made via the App or either Website is shipped. Prior to shipment of a digital order, any Points available relating to such order will be deemed pending and not yet earned. Account balances are visible via the Member's Account in the App or on the applicable Website.

e. Cancellations, Modifications or Refunds. If you cancel an order for which you have earned Points, or request a refund for a qualifying purchase, any Points associated with that order/purchase will be deducted from your Account. If you modify an order before it is shipped, any Points associated with the original order are subject to change. This can cause a Member to have a negative point balance if previously earned Points were used in the interim to claim a Reward.

f. Bonus Point Promotions. Dooney & Bourke may offer certain bonus point promotions under which Members can earn additional or bonus points in connection with purchases or in connection with other specially designated limited time promotions. Such promotions are subject to the terms and conditions of the corresponding offer, along with these Terms, and may be offered at any time in Dooney & Bourke’s sole discretion.

g. Other Ways to Earn Points. Members may also earn Points by following Dooney & Bourke on social media, subscribing to Dooney & Bourke’s newsletter, or completing other tasks as described at in the Loyalty Dashboard. Points earned for these actions will be posted in the Member’s Account within 72 hours after completing the qualifying activity.

h. Points Disputes. If you believe that a purchase should have resulted in the addition of Points to your Account, and such Points are not posted to your Account within the period of time stated above for any purchase or qualifying activity ("Points Dispute"), please contact customer service. We will use reasonable efforts to investigate your Points Dispute so long as you notify us of such dispute within ninety (90) days of the purchase or qualifying activity. If you do not notify us within such ninety (90)-day period, you will have waived your right to make a Points Dispute with respect to that purchase. In order for us to undertake an investigation of your Points Dispute, we may require you to provide written confirmation of the dispute. If we do not receive the requested written confirmation at the address and within the time requested by us, we may in our sole discretion determine not to investigate your Points Dispute. Upon completion of our investigation of your Points Dispute, we will have no further responsibilities should you later reassert the same Points Dispute.

i. Points Expiration. Points expire 365 days from the day they were earned. No credit or cash will be given for unused or expired points.

4. REDEEMING POINTS

Points earned by a Member may be redeemed for a reward value only toward purchases of qualifying products, and only via the App or the Websites. Points are not redeemable in stores, and are not redeemable toward the cost of taxes, shipping, gift cards, or past purchases.

You must have at least 100 valid Points posted in your Account before you can redeem Points on any purchase. After you have at least 100 Points in your Account, your available Point reward value will appear at checkout when you are shopping in the App or at either of the Websites while logged in to your Account. You may elect how much of the Point reward value you wish to use toward your purchase. The system will calculate and display your remaining Points after you redeem any Point reward value.

Dooney & Bourke may determine, in its sole discretion, to restrict the redemption of Points with respect to certain products. Except where required by law or provided for in these Terms, Points have no cash value and no exchange rate to any market currency, and are not your property. Other restrictions may apply.

Point reward value redemption is not available when checking out with alternative payment methods (ApplePay, PayPal, etc.) or DooneyPay.

5. PROGRAM TIERS

a. Description of Tiers. The Program offers different benefits based on different Point levels (“Tiers”). The Program consists of three (3) Tiers, as determined by the number of Points that you accumulate in your Account annually on a rolling basis, beginning on the date 365 days prior to today’s (“Rewards Year”). The benefits that are available to you through the Program are based on your Tier status and on the number of Points that you earn by making qualifying purchases or completing qualifying actions.

Tier status lasts from the date you reach a specific Tier until the last day of the full Rewards Year. For example, if you reach the Ambassador Tier with a purchase on January 1, 2020 and as of January 1, 2021, you still qualify for Ambassador Tier status, you would keep your Ambassador status until your Annual Spend dips below what’s required for Ambassador Tier status in the prior 365 days. Members will be upgraded during the Rewards Year if their Point balance exceeds their Tier thresholds. Members should allow up to 72 hours for qualifying purchases or qualifying actions to process before being placed in a different Tier. Once you reach the level of Points to move to a new Tier, or have failed to maintain enough points to remain at the Ambassador or Loyalist Tiers, Dooney & Bourke may send you a notice of your change in Tier status. To receive notice of Tier status changes, you must not be opted out from receiving marketing communications from Dooney & Bourke. See Loyalty Dashboard for specific benefit details for each Tier.

New Dooney & Bourke customers who enroll in the Program will be enrolled in Tier 1 (“Insiders”), and will be eligible to start receiving Points and other benefits as set forth herein. Tier status will remain in effect until Annual Spend drops below Tier status requirements.

b. Tier 1 - Insider
Insiders earn 1 Point for each $1.00 spent on qualifying purchases as described in Section 2. They will also enjoy various benefits outlined in the program here. Benefits are subject to change at any time.

c. Tier 2 - Ambassador
Ambassadors earn 1.25 Points for each $1.00 spent on qualifying purchases as described in Section 2. Each Member who spends at least $250 in the prior 365 days will become an Ambassador. They will also enjoy various benefits outlined in the program here. Benefits are subject to change at any time.

d. Tier 3 - Loyalist
Loyalists earn 1.5 Points for each $1.00 spent on qualifying purchases as described in Section 2. Each Member who spends at least $750 in the prior 365 days will become a Loyalist. They will also enjoy various benefits outlined in the program here. Benefits are subject to change at any time.

6. PROGRAM BENEFIT DETAILS

a. General. Each Tier offers different benefits, some of which are detailed below. These benefits are offered at the sole discretion of Dooney & Bourke. Benefits may be added to, or removed from, the Program at any time without notice.

b. Birthday Reward. To receive an annual birthday reward, you must (i) must have a valid birthday and U.S. email address on file with your Account, (ii) not be opted out from receiving marketing communications from Dooney & Bourke via email, and (iii) have at least one purchase shown in your Account within the last twelve (12) months prior to your birthday month. An Account opened on your birthday month or the previous month will receive the birthday reward during your birthday month the following calendar year, assuming all other conditions are satisfied.

c. Exclusive Early Access and Special Offers. In order to receive notice of exclusive early access and special offers, you must not be opted out from receiving marketing communications via email. Exclusive early access and special offers are in Dooney & Bourke’s sole discretion. Complete details will be sent to eligible Members. This benefit has no cash value and is non-transferable. The exclusive early access and special offers you receive may be dependent upon your Tier status. Other terms and limitations may apply and will be provided via email or direct mail.

d. Free Shipping. Free shipping and shipping upgrades may be available to members at certain Tier levels. Free shipping only applies to orders shipped to a single address within the contiguous United States. Additional charges may apply for all other shipping options and destinations. Free shipping does not apply to international orders. Offer cannot be applied to previous purchases and cannot be redeemed for cash. See here for full shipping details. e. Promotional Offers. Dooney & Bourke may, from time to time, post certain promotional offers to your Account. Promotional offers will be subject to the terms and conditions of each respective promotional offer, including, without limitation, minimum qualifying purchase requirements and applicable expiration dates.

7. GENERAL

a. Binding Terms. By joining the Program, you agree to be bound by these Terms and all terms applicable to having an Account, including but not limited to Dooney & Bourke’s Privacy Policy and on Terms & Conditions.

b. Modifications/Termination of Program or Terms. Dooney & Bourke reserves the right, at its sole discretion, to suspend, modify, restrict, or terminate any aspect of the Program at any time, including, without limitation, the earning rate(s), conversion/redemption rate(s), and expiration policy for all Points and other benefits. Notification of changes will be given in the App and on the Websites. Dooney & Bourke may make these changes even though the changes may affect the Member’s ability to use Points or benefits already accumulated. You are responsible for remaining knowledgeable about the Terms. Continued participation in the Program after any posted change(s) constitutes acceptance of the change(s).

c. Account Balances. Dooney & Bourke reserves the right to determine the amount of Points in any Member's Account based on Dooney & Bourke’s internal records related to such Member's Account. In the event that there is an inconsistency between the points accrued in your Account and what you believe you should have based on your purchase receipt(s), please contact our customer service team to evaluate the situation. Dooney & Bourke assumes no responsibility for errors caused by incorrect Member information. All decisions by Dooney & Bourke on reconciliation of account balances are final and binding.

d. Abuse by Member. Dooney & Bourke may revoke any Member's membership at any time if such Member engages in abuse of the Program or fails to follow these Terms. Without limiting the foregoing, the sale of Points or benefits is prohibited and may result in the confiscation or cancellation of your Points and/or benefits as well as suspension or termination of your membership, which in each case shall be final and conclusive. Fraud or abuse relating to the accrual of Points or claiming or redemption of benefits may result in revocation of membership in the Program and may affect a Member's eligibility for participation in any other Dooney & Bourke programs.

e. Eligibility Verification. All Member enrollments are subject to verification at any time and for any reason. Without limiting the foregoing, Dooney & Bourke may require proof of identity and/or eligibility at any time. Failure to provide such proof when requested may result in disqualification and termination of any Account.

f. Promotional Program Only. Points and benefits are purely promotional offers, do not constitute property of any Member, are non-transferable, have no cash value, and cannot be redeemed for cash or gift cards. No portion of any qualifying purchase constitutes consideration paid for any Points, benefits, or other promotional benefit.
